By accessing or using our Services, you agree to be bound by these Terms.

If you are using our Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration

- Outbound AI Agents: AI-powered voice agents that place calls from your lead lists
Custom Voice Solutions:
- Enterprise solutions including voice cloning, API integrations, high-volume pricing, and white label options
Lead Gen System:
- Comprehensive lead generation solutions combining data sourcing, marketing channel deployment, and campaign management
5. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in compliance with all applicable laws and regulations. You agree NOT to:
5.1 Compliance Violations
- Violate the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), or any other applicable federal, state, or local laws
- Contact numbers on the National Do Not Call Registry without proper consent
- Send communications without proper prior express consent as required by law
- Misrepresent your identity, affiliation, or the purpose of your communications
5.2 Prohibited Content
- Transmit fraudulent, deceptive, or misleading messages
- Promote illegal products, services, or activities
- Send communications containing threats, harassment, or abusive content
- Distribute content that infringes on intellectual property rights
- Transmit malware, viruses, or other harmful code
5.3 Technical Violations
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt our Services or servers
- Use automated means to access our Services without permission
- Reverse engineer or attempt to extract source code from our platform
5.4 List Quality Requirements
- Upload only lead lists that comply with applicable consent requirements
- Maintain accurate records of consent for all contacts
- Scrub lists against the National Do Not Call Registry as required by law
- Remove opt-out requests within the timeframes required by law
6. TCPA Compliance
You acknowledge and agree that:
- You are solely responsible for ensuring your use of our Services complies with the TCPA and all other applicable telemarketing laws
- You have obtained all necessary prior express consent (or prior express written consent where required) before initiating any communications
- You will honor all opt-out requests promptly as required by law
- You will maintain records of consent as required by applicable regulations
- Pushkin Voice is a technology provider and does not guarantee compliance; compliance is your responsibility
Violations of telemarketing laws may result in significant penalties. We strongly recommend consulting with legal counsel to ensure your campaigns comply with all applicable laws.
7. Subscription and Payment Terms
7.1 Subscriptions
- All subscriptions are billed monthly and auto-renew on your billing date
- Subscription fees are non-refundable except as required by law
- You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period
7.2 Usage and Minutes
- Minutes and credits reset to zero at each monthly renewal
- Unused minutes or credits do not roll over to the next billing period
- Add-on purchases are valid only until your next billing date
7.3 Overages
- If you exceed your allocated minutes or credits, additional usage will be charged to your payment method on file
- Overage rates are specified in your service agreement
7.4 Payment
- You authorize us to charge your payment method for all fees associated with your account
- You are responsible for keeping your payment information current
- Failed payments may result in service suspension
8. Audio Content Review
For services requiring audio files (Voice Drop, Tap Drop, Blast Drop), all uploaded audio content is subject to review for compliance with our Acceptable Use Policy. We reserve the right to reject or remove audio content that violates these Terms or applicable laws.
9. Service Level and Processing Times
- Service requests, including agent setup, status changes, and lead processing, are handled during business hours: 9:00 AM to 5:00 PM Eastern Time, Monday through Friday
- Requests submitted outside business hours will be processed the next business day
- We strive to process requests within 1-2 business hours during normal operations
10. Intellectual Property
10.1 Our Property All content, features, and functionality of our Services, including but not limited to software, text, graphics, logos, and trademarks, are owned by Pushkin Voice and are protected by intellectual property laws.
10.2 Your Content You retain ownership of any content you upload to our Services. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing our Services to you.
11. Disclaimers
11.1 "As Is" Basis OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 No Guarantee We do not guarantee that:
- Our Services will be uninterrupted, secure, or error-free
- Results obtained from using our Services will be accurate or reliable
- Any specific delivery rates, connection rates, or conversion rates will be achieved
11.3 Third-Party Services Our Services may rely on third-party telecommunications providers and other vendors. We are not responsible for any failures, delays, or issues caused by third parties.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUSHKIN VOICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pushkin Voice and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

- Your violation of any applicable laws, including TCPA and telemarketing regulations
- Any content you upload or transmit through our Services
- Any claims by third parties related to your communications or campaigns
14. Termination

14.2 By Us We may suspend or terminate your access to our Services immediately, without prior notice, if:
- You violate these Terms
- You violate applicable laws or regulations
- Your use of our Services poses a risk to us, our users, or third parties
- Required by law or legal process
14.3 Effect of Termination Upon termination, your right to use our Services ceases immediately. We may delete your account data in accordance with our data retention policies.
